Brazil’s indirect tax overhaul saw two notable updates in July 2026. The federal government pushed back certain registration and invoicing duties for individual taxpayers until 2027, while tax authorities continued building out the operational framework for the new CBS and IBS VAT regime, including electronic invoicing changes still set to take effect in August 2026. Neither development changes the compliance outlook for non-resident digital service providers. 

Decree No. 13,075: Relief for Individual Taxpayers

On July 21, 2026, Brazil issued Decree No. 13,075, amending Decree No. 12,955, which governs the operational rules for the federal Contribution on Goods and Services (CBS).

Under the new decree, the following obligations are pushed back to January 1, 2027:

  • Mandatory enrolment in the National Register of Legal Entities (CNPJ) for individuals who act as CBS taxpayers or tax-responsible parties;
  • Mandatory issuance of CBS tax documents by those same individuals; and
  • Equivalent obligations for certain rural producers.

The relief is limited to individual taxpayers. It does not affect the CBS reform’s broader timeline or the obligations of legal entities and foreign businesses.

August Still Marks a Major Milestone

Despite the reprieve for individuals, companies still need to prepare for the reform’s next phase. Throughout 2026, Brazil is running a transition period in which businesses report CBS and IBS at provisional test rates:

  • CBS: 0.9%
  • IBS: 0.1%

These figures exist purely for testing and transitional purposes, allowing tax authorities to validate new systems before the regime becomes fully operational.

Changes to Brazil’s electronic fiscal document infrastructure are due to become mandatory starting in early August 2026. Fiscal documents, including NF-e, NFC-e, and NFS-e, are being revised to incorporate the new CBS and IBS data fields. Businesses already issuing these documents should confirm that their ERP, invoicing, and tax platforms support the updated XML structures and validation rules.

Implementation Dates Still Being Finalized

The August 3, 2026, deadline took effect as scheduled under Joint Act RFB/CGIBS No. 4/2026. However, on July 31, 2026, Receita Federal and the CGIBS issued Joint Technical Act RFB/CGIBS No. 1/2026, which postponed the enforcement of automated validation rules that would reject fiscal documents (such as NF-e, NFC-e, CT-e, and others) missing CBS/IBS fields. As a result, documents without these fields are still being authorized rather than rejected. On August 6, 2026, authorities clarified that this postponement only applied to the automatic rejection mechanism and did not suspend the legal requirement to report CBS/IBS data.

Brazilian authorities have signaled that further joint acts and technical notes may still follow as implementation continues, so businesses should continue to monitor official publications from the Receita Federal and the CGIBS.

What This Means for Non-Resident Digital Service Providers

The July changes leave the anticipated compliance timeline for non-resident digital service suppliers unchanged. Based on legislation issued so far:

  • Foreign digital service providers will be expected to register for CBS under the new regime;
  • Marketplace operators may become liable in certain scenarios;
  • Additional guidance on registration, invoicing, and compliance obligations is still forthcoming; and
  • Substantive CBS collection by non-resident suppliers is expected to begin on January 1, 2027.

Several operational details remain under development, including the registration process for foreign suppliers, e-invoicing requirements, and how B2B transactions will interact with the reverse-charge mechanism.
