Germany’s Federal Ministry of Finance (BMF) published its third guidance letter on electronic invoicing on October 15, 2026, clarifying several practical implementation questions ahead of the mandatory B2B e-invoicing threshold taking effect on January 1, 2027.

Mandate Context

From January 1, 2027, businesses in Germany with 2026 turnover exceeding 800,000 euros must issue structured e-invoices for domestic B2B transactions; this deadline remains unchanged under the new letter.

Key Clarifications

  • Validation errors: Technical validation errors do not automatically invalidate an invoice for VAT purposes. Businesses are advised to check whether their accounts payable systems incorrectly reject invoices that otherwise remain valid.
  • Mandatory invoice data: All mandatory VAT information must be included in the structured part of the e-invoice.
  • Attachments: Supporting documentation, such as timesheets or bills of quantities, can be included as embedded attachments to the structured e-invoice.
  • Invoice corrections: Corrections to e-invoices must themselves be issued as e-invoices, though the BMF allows some flexibility in how corrections are made.
  • Advance payments: Transitional arrangements for final invoices involving advance payments remain in place until June 30, 2030.

Transitional Treatment

Invoices issued up to December 31, 2026 that follow the BMF’s previous guidance will not be challenged solely for not meeting the new letter’s requirements.
